DAUPLER, INC. PRIVACY POLICY

Your privacy is important to us. It is Daupler, Inc.’s (“Daupler”) policy to respect your privacy regarding any information we may collect from you in your use of the Daupler web-based Incident Response Management System and its services ("Services") located at www.daupler.com (the "Website"). Please note that the Services and Website, together with any services or software we make available through or in connection with such Services or Website, are collectively referred to as the “Platform”. References to “we,” “us,” and “our” refer to Daupler.

This Privacy Policy is incorporated into our Standard Terms and Conditions, which govern your use of the Platform. Capitalized terms used in this Privacy Policy that are not otherwise defined have the meaning given to them in the Standard Terms and Conditions.

PLEASE REVIEW THESE POLICIES CAREFULLY. BY USING ANY PART OF OUR PLATFORM, YOU ARE AGREEING TO BE BOUND BY OUR POLICIES. Please note that using our Platform is your choice. If you do not agree with our policies, you should not use the Platform.

  1. What We Collect and How We Collect It

We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. For example, when you first sign up to use the Platform you are asked to review and accept our Standard Terms and Conditions and this Privacy Policy. Similarly, we want you to understand what information we collect about you, how we collect that information, how we use it, and what your rights are with respect to what we do. This Privacy Policy explains those things.

We collect several types of information from and about individual users of the Platform, including information by which you might be personally identified. A few examples of how and when this may happen include:

  • you create an account on the Platform;
  • you access, use, view content on, and/or otherwise interact with our Platform or your account;
  • you submit personal information about yourself on our Platform by uploading it, or by sending communications to us or third parties, or by inviting others to use or view our Platform;
  • you submit personal information about others on our Platform by uploading it, or by sending communications to us or third parties, or by inviting others to use or view our Platform; or
  • you interact with us with respect to account maintenance or service (for example: billing or technical support, and Platform updates).

Please note that except as set out in this Privacy Policy, we do not collect or scrape additional information from the computers, contacts, email accounts, or other personal sources of account holders and individuals accessing or using our Platform.

We may collect and use generalized, anonymous information about all visitors and users of our Platform. This information cannot be used to identify or isolate your personal information.

  1. How We Use and Disclose Personal Information

We use and/or disclose personal information solely for the purpose of providing and improving our Platform to and for our users. We do not attempt to monetize personal information by selling or sharing it with third parties.

Specifically, we use and/or disclose personal information (i) to operate and improve our Platform; (ii) with third party vendors as necessary to provide, promote, or operate our Platform (for example: to facilitate call answering services); (iii) to comply with applicable laws, regulations, and other legal purposes; (iv) to detect and manage fraud, security, and technical issues; (v) to protect the safety and rights of individuals, the public, and Daupler; (vi) to contact you about your account or your use of the Platform; (vii) to contact you about the Platform and related resources; (viii) for account servicing and maintenance; (ix) to measure and improve client engagement; (x) for corporate business purposes (for example: to our current or future parents, affiliates, subsidiaries, and other companies under common control and ownership, or to a buyer or other successor in connection with, or during negotiations for, a merger, acquisition, reorganization, or other sale or transfer of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding); and (xi) otherwise as you direct or consent.

When we use personal information with third party vendors, those vendors are not allowed to access or use information from us, except only as needed to do their particular work with us, and we will condition use of that information on strict confidentiality restrictions as much as possible.

When we use personal information for legal purposes or in connection with our corporate business purposes, we will try to limit the information we provide as much as possible, and we will condition our sharing of that information on strict confidentiality restrictions as much as possible.

We may also use anonymized or generalized aggregate information about users of the Platform for various reasons, including to promote and improve our Platform. In these circumstances, we will take appropriate measures to de-identify (and prevent any party from re-identifying) any information used in this way.

  1. Third Party Links and Services

We use third party providers for various aspects of our Platform (for example: to facilitate call answering services). By using our Platform, you will also be subject to the third party policies and practices for those third party products and services, as is further set out in our Standard Terms and Conditions. Those third party policies may be materially different than our policies, especially with regard to information privacy and security. If you choose to use our Platform in ways that rely on third party products and services, you do so at your own risk with respect to those third party policies and practices.

In addition, our Platform may link to external sites, products, and services that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and we are not responsible or liable for their respective privacy policies and practices. If you choose to access or use any such third party site, product, or service, you do so at your own risk.

  1. How we Retain and Protect Personal Information

The security of personal information is very important to us, and we continuously work to protect that information well and to improve our practices. We have taken steps that we believe are reasonable to safeguard against the unauthorized access and use of personal information. However, we cannot and do not guarantee the total security of your information in all circumstances.

Securing the information we store and transfer is very important to us, and we continuously work to do that well and to improve our data storage and transfer practices. By using our goods and services, or providing us with any information, you are consenting to the transfer, processing, usage, sharing, and storage of your information, including personal information, in the United States and in the other jurisdictions where we do business.

We may retain your information, including personal information, for as long as permitted under applicable law. Daupler may choose in its discretion to dispose of your information in accordance with applicable law.

  1. Advertising and Marketing; Tracking; Opt-Out

As explained above, we may use your information for limited advertising and marketing purposes, including to contact you about products and services that we believe may be of interest to you, and to promote events and other resources that you may be interested in.

Our marketing communications will include instructions for how to opt-out of all or a portion of these communications, or change your preferences. You may also contact us by email at question@daupler.com to manage your marketing communication preferences at any time.

We may use cookies, beacons, and other similar tracking technologies. For example, we use cookies to help us measure and improve our engagement with our users by analyzing the usage trends and patterns for our Platform, and to promote products and services that we believe may be of interest to you. In some cases, you may manage the use of cookies for our products and services by adjusting your individual browser settings. Please note that our products and services do not currently process “do not track” features offered by some browsers and devices.

  1. Children Under Thirteen

We do not permit individual users under the age of 13. Daupler does not knowingly collect personally identifiable information from children under the age of 13. Any attempt by a person under the age of 13 to use the Site will be automatically void. If Daupler receives credible notice that a user is under the age of thirteen, Daupler will promptly remove the user and delete all information about and from that user.

  1. California Privacy Notice

This California Privacy Notice applies only to individual users of our products and services who are residents of the State of California, and only where we act as a “business” with or for that individual. For example, this section applies for California residents who use our products and services as an individual user. For these users, this section is a supplement to the other parts of our policies.

This California Privacy Notice describes how we as a business collect, use, disclose, and otherwise process personal information of individual residents of the State of California within the scope of the California Consumer Privacy Act of 2018 (“CCPA”). You have the right to request specific pieces of personal information that Daupler has collected about you.

The categories of personal information that we have collected about consumers in the preceding 12 month and the sources from which we collect that information are listed below. Daupler collects the following personal information for both business and commercial purposes as outlined in Section 2 above.

We may use and/or disclose personal information with third parties to measure and improve client engagement (for example: we use Google Analytics and Heap Analytics to help us understand how our users use our products and services).

Third party security and technology providers

We may use and/or disclose personal information with third parties for servicing and maintaining our products and services (for example: to help us with security measures, billing, or technical support).

Please also see section 2 above for more information about how we may disclosure personal information. We may in some instances disclose personal information with third parties for other purposes than what is set out in the table above (for example: in connection with our corporate business purposes or for legal purposes).

As also discussed in section 2 above, we may disclose personal information to the following categories of third parties for a business purpose. The following is a list of the categories of personal information Daupler has disclosed for a business purpose about consumers in the preceding 12 months: Identifiers; customer record information; internet or other electric network activity information; geolocation information; audio, electronic, visual, or similar information; and employment or professional information.

Please note that we do not attempt to monetize your personal information with third parties. Daupler has not sold personal information about consumers in the preceding 12 months.

Please also see section 2 above for more information about the personal information we collect. We may in some instances collect personal information other than what is set out in the table above (for example: for legal purposes).

If you are a qualifying California resident under CCPA, we provide the following rights with respect to your personal information when we act as a “business” with or for you (subject to certain limitations in the CCPA):

Right to delete

Upon verifiable request we will delete personal information we have collected about you, subject to certain exceptions in the CCPA.

Right to opt out of sales to third parties

We do not sell your personal information to third parties.

Right to not be subject to discrimination for enforcing your CCPA rights

You will not be discriminated against by us for your exercise of CCPA rights. However, please note that in some instances, exercising certain CCPA rights may cause us to be unable to provide you with our products and services.

Please note that we will need to verify your identity before processing CCPA and other California requests, which may require us to request and obtain additional information from you. We will use that information only to review and address your requests. We reserve the right to decline or limit requests in certain circumstances – for example, when we are unable to verify your identity or locate information in our systems, when you have previously made two CCPA requests in the prior 12 months, or as otherwise permitted by applicable law.

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your CCPA and other California rights. Before accepting such a request from an agent, we will require the agent to provide us with proof that you have authorized it to act on your behalf, and we may also need you to verify your identity directly with us.

Please note that we will also comply with valid requests from California residents that have an established business relationship with us under California’s “Shine the Light” law.

  1. Your Choices and Rights

You are free to refuse our request for personal information in any instance, with the understanding that we may be unable to provide you with some aspects of the Platform.

Your continued use of the Platform will constitute acceptance of this Privacy Policy and our practices around privacy and personal information. If you have any questions about how we handle user data and personal information, feel free to contact us.

  1. International User Notice

Please note that we are based in the United States, and your information will be transferred, processed, and stored in the United States. If you submit personal information from outside the United States, you hereby consent to the transfer, processing, and storage of the information to and in the United States, and the exclusive application of the laws of the State of New York, United States, with regard to the collection and use of such information.

If you are an individual resident of the European Union, you have certain rights with respect to your personal information, including under the General Data Protection Regulation (“GDPR”). This includes, among other rights, the right to be informed and request access to the personal information about you that we have collected via our Platform. You may also have the right to ask that your personal information be corrected, updated, or deleted.

Please note that we will comply with valid requests from residents of the European Union subject to relevant legal exemptions. Please also note that we will need to verify your identity before processing any such requests, which may require us to request and obtain additional information from you. We will use that information only to review and address your requests. We reserve the right to decline or limit requests in certain circumstances – for example, when we are unable to verify your identity or locate information in our systems, or as otherwise permitted by applicable law.

We may change these policies from time to time in our discretion. Any changes will be effective immediately upon us posting the updated policy. New policies will be posted at this page, and we encourage you to review it regularly. If we make updates or changes, we will give notice of that by updating the posted date for this policy and, in some cases and in our sole discretion, we may provide you with additional notice (for example: by notice on our Platform or by sending you a notification).
